Sikora, 173 So.3d 1028 (Fla. 2d DCA 2015), the trial court penalized the wife for failing to produce receipts for medical expenses paid during the divorce. Because there was no finding of misconduct or intent to hide assets, the appellate court reversed.

This principle protects parties from arbitrary financial punishment and keeps the focus on fairness. Courts must tie any unequal outcomes to conduct supported by evidence, not merely disorganized or missing paperwork.

Failing to track cash withdrawals and deposits
Not retaining receipts for large expenses or improvements to marital property
Co-mingling personal and marital funds without clear logs
Relying solely on verbal agreements without backup

Judges are looking for good faith efforts and reasonable credibility. Lack of perfect recordkeeping won’t alone justify adverse rulings, but it can make your case more difficult to prove.
