Equitable Distribution Must Be Final

A final judgment must fully resolve all aspects of equitable distribution. In Fischer v. Fischer, 224 So.3d 919 (Fla. 1st DCA 2017), the trial court left issues regarding the marital home unresolved. The appellate court found the judgment was nonfinal and unenforceable.

Unresolved distributions can create confusion and delay. To avoid this:

• Ensure every asset and liability is accounted for.
• Avoid vague language about “future agreements” or “pending decisions.”
• Ask the court to reserve jurisdiction only for specific, narrow issues (e.g., QDRO preparation).

A judgment that fails to address all marital property can trigger appeals, enforcement issues, and additional hearings—undermining the goal of closure. Family law practitioners must advocate for clarity and finality to protect their clients’ financial interests.

If one party refuses to disclose financial information or delays cooperation, courts should issue clear orders compelling compliance. When certain items cannot be valued or divided yet, the court must still make a ruling or formally reserve jurisdiction with specific language explaining the reason and timeline.

Litigants should also:

• Double-check that each account, retirement fund, vehicle, property, and debt is listed in the final judgment.
• Seek clarification or modification if anything appears incomplete.
• Avoid assumptions that future cooperation will fill in the gaps.

Final means final—and incomplete rulings waste time, money, and energy.
